Judge Maryann Sumi in Madison Wisconsin has issued a temporary restraining order on a new collective bargaining law passed by the senate recently...
This order prevents State Doug La Follette from publishing the law until she can rule on the merits of the case...
The Judge says the legislative committee violated the state's open meeting law..
Some say this is bogus, Is the Judge trying to make a name for herself in history or maybe she just don't know Wisconsin's state Rules..
Wisconsin's State Rule number 93 plainly shows that all rules were followed by the senate, if voting during a "special session" which is exactly what this vote was...
Senate Rule 93 (2)
(2) A notice of a committee meeting is not required other than posting on the legislative bulletin board, and a bulletin of committee hearings may not be published.
Senate Rule 93 (3)
(3) The daily calendar is in effect immediately upon posting on the legislative bulletin boards. The calendar need not be distributed.
Senate Rule 93 (4)
(4) Any point of order shall be decided within one hour.
Senate Rule 93 (5)
(5) A motion may not be entertained to postpone action to a day or time certain.
Senate Rule 93 (6)
(6) Any motion to advance a proposal and any motion to message a proposal to the assembly may be adopted by a majority of those present and voting...
Asst. Atty. Gen Steven Means, who was part of the state's legal team, said after the ruling that "we disagree with it."
"And the reason they have appellate courts is because circuit court judges make errors and they have in this case."
Means said the state would "entertain an appeal."
"If the Legislature decides to go back and re-act on these provisions, they have the right to do that. And we will see what happens," he said.
Shouldn't a judge up hold the law until they find if, it has indeed broken senate rules . Shouldn't the Judge believe that the legislature knows what it is doing....Why would she just take the word of a Liberal, when he says the vote was in violation of senate rules?...
Perhaps we should just save money and fire all of the legislative members and let the Judges make the rulings....
